Digital deception decoded for e-commerce services

In today’s digital ecosystem, subtle yet misleading tactics, known as dark patterns, are commonly used by online platforms to manipulate user behaviour. From hidden costs to deceptive urgency, these tactics undermine user trust and can lead to regulatory repercussions.

To strengthen transparency and accountability in digital interactions, the Department of Consumer Affairs introduced the guidelines for Prevention and Regulation of Dark Patterns in 2023, protecting consumer interests across all sellers, advertisers and marketplaces in India.

Reinforcing this framework, the Central Consumer Protection Authority (CCPA) issued an advisory on 7 June 2025, urging e-commerce platforms to conduct self-audits and submit declarations confirming their compliance with these rules.

Common dark patterns & their impact

  • False urgency: Misleading scarcity tactics to push immediate purchases.
  • Basket sneaking: Adding extra items at checkout without user consent.
  • Confirm shaming: Using fear or guilt to persuade users into a purchase.
  • Bait & switch: Promoting one outcome but delivering another.
  • Drip pricing: Revealing costs only after purchase confirmation.
